Since people are asking about eljay's stance on fair use, from the TOS:
LiveJournal and its designates shall have the right, but not the obligation, to remove any content that violates the TOS or is otherwise objectionable, or that infringes or is alleged to infringe intellectual property rights. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. Furthermore, LiveJournal reserves the right to limit access to your journal, if found in violation of the TOS, including without limitation the Member Conduct described below, by removing the journal and related user information from the member directory, search engine, and all other methods used in conjunction with finding LiveJournal's users.
There is a rumor that the community was closed down due to a complaint from prominent writer Peter David, in response to finding a scan of one of his current comics. This rumor is currently unsubstantiated, and is based on a comment that does not exist anymore due to deletion of the community. Edit: David has responded to the accusations on his own blog:
Conscientious people have reported to me when they see flagrant copyright violations of my work (typically entire Star Trek novels being posted online). So I did the same thing, informing Marvel of the scans.
Did Marvel then shut them down? No. Because before Marvel legal had an opportunity to do anything, the scans had already been removed for being a violation of terms of service of Photobucket, the site that enabled the posters to put up pictures on line. Perhaps the CBR links put the site on PB's radar as well as mine.
I did, however, use my wife's Live Journal account to make my presence known. A fan asked if I had informed Marvel about the scans. An honest question. I replied honestly. I said yes, I had, but that the scans were pulled before Marvel took any action.
Two days later, Scans Daily was shut down completely.
Speaking for myself, I was one of those who started buying comics again because of Scans_Daily. I had been lurking there for a while when someone started posting from the Giffen/DeMatteis JLA Classified issues, "I Can't Believe It's Not the Justice League." If it hadn't been for those scans, I would never have gone into my local comics shop. By the time the Gargoyles comics started coming out, I was a regular customer. Scans_Daily may have provided that horror -- free comics! on the Internet! -- but it also exposed fans to new books and fascinating back issues that we simply would not have discovered any other way. I can only hope Marvel and DC will see what a resource they're about to lose, and step in to save this valuable review site.
